Terms and Conditions




By requesting us to undertake work on your behalf or by using our products or services you agree to these terms and conditions:

1. General
1.1 If you request work it is assumed that you have full rights to authorise and commission that work on behalf of the company or individual that you are representing.
1.2 No responsibility can be accepted from any person or organisation for any actual or consequential loss or damage caused by the use of the service nor for its non-availability nor for the time taken to deliver the required work.
1.3 Any service may be changed or withdrawn at any time without notice. However, we will aim to communicate any such change at least 30 days before implementation.
1.4 Prices may be changed at any time without notice. However, we will aim to communicate any proposed changes to prices or billing structure at least 30 days before implementation
1.5 Invoices become due for payment 30 days after emailing to the address that you provided. Failure to pay an invoice for a service will lead to the service being suspended, which may in some cases cause your website to be unavailable.
1.6 No responsibility can be accepted for credit card transactions. Credit card transactions are handled separately and securely by PayPal Europe Ltd to whom any transaction queries should be addressed. Your credit card details are never seen by us.
1.7 Support where provided will be via email. Telephone support will not normally be available.
1.8 A product may include software from other suppliers whose terms and conditions may apply to the installation. Where this applies and where possible, this will be indicated in the product user manual or online help pages.
1.9 Additional conditions may apply to some products and services, for example for a demonstration facility. These will be indicated on the websites for those products and/or in additional paragraphs in this document.


2. Software-as-a-Service (s-a-a-s) products
2.1 You must not use any of our systems or services for obscene, defamatory or criminal purposes nor to store data of these types.
2.2 The data entered into the system and held on your behalf is your full responsibility and should be registered by you under the Data Protection Act if appropriate.
2.3 User passwords should be kept secret and changed frequently by you to protect your data.
2.4 Where an email facility is provided, the system must not be used to send unsolicited emails.
2.5 You are responsible for keeping your own backups of essential data entered into the system by using a download facility where provided.
2.6 You must not sell-on access to or usage of the service to others.
2.7 The service may be suspended if the above conditions are not met.
2.8 For a newly-provided system, adaptations will be made to the system configuration following your request at no additional cost for a period of 30 days from the date the system becomes available. Configuration changes after this period may be charged for.
2.9 Every reasonable effort will be made to ensure that the system is available without interruption however circumstances inevitably may arise over which we have no control and which may mean that availability is less than 100%.
2.10 If the system is withdrawn, as much notice as is reasonably practicable in the circumstances will be given. No compensation will be payable nor will be due or be made for any reason other than, if possible, a refund of any advance subscription payments already paid calculated on a proportional daily basis. In this circumstance and if it can be achieved, any user job data on the system will be archived and supplied to you on CDrom at the your registered address at no charge. If a web page has been provided as part of the setup package, this will be switched off on the date of cessation.
2.11 If the service provided by the system is cancelled by you, no notice is required subject to the payment of any outstanding charges to the date of cessation. A refund will be made of any advance subscription payments already paid calculated on a proportional daily basis. If web pages have been provided as part of a setup package, these will be switched off on the date of cessation.


3. Website design and modification
3.1 Our role is solely to assist you in achieving a successful internet presence by providing the technical and design support that you require. You are responsible for your own editorial content and for ensuring that all published material including any third-party advertisement on your web site does not offend appropriate legislation and publication standards and does not breach the copyright of others.
3.2 Images, movies and audio clips will normally be supplied under an unrestricted use licence, but remain the copyright of their respective owners.
3.3 Where we do not provide the website's hosting facility, the creation and operation of and payment for an account with an Internet Services Provider (ISP) is your responsibility.


4. Website hosting
4.1 If you decide to have us host your website, the technical part of this service will be procured from a major website hosting organisation in the UK, Europe or the USA so as to ensure the optimum reliability and quality. Therefore the availability of the hosted website will depend on factors outside our control.


5. Free, demonstration and bonus applications
5.1 Free, demonstration and bonus applications whether available via an internet site or by any other means are offered only as samples without warranty of any kind including of fitness for any purpose.
5.2 Users should satisfy themselves that the provided sample is appropriate for their particular requirements therefore no responsibility can be accepted for any consequences of the use of the application.
5.3 Free, demonstration and bonus applications may be withdrawn or changed at any time without notice.


6. Advertising
6.1 We may use third-party advertising companies to serve ads when you visit our websites. These companies may use information (not including your name, address, email address or telephone number) about your visits to this and other websites in order to provide advertisements about goods and services of interest to you.
